In this chapter:
14. Foreign State: Includes outlying possessions of a foreign state, excluding self-governing dominions or territories under mandate or trusteeship, which are considered separate foreign states.
15. Immigrant: Refers to every alien except nonimmigrant aliens falling into the following classes:
(A)

(i) Ambassadors, public ministers, or career diplomatic or consular officers accredited by a recognized foreign government, accepted by the President or Secretary of State, along with their immediate family.

(ii) Officials and employees accredited by a recognized foreign government, accepted by the Secretary of State, and their immediate families, based on reciprocity.

(iii) Attendants, servants, personal employees, and immediate family members of officials and employees under (i) and (ii) above, based on reciprocity.
(B) Alien residents of a foreign country with no intent to abandon residence, visiting the U.S. temporarily for business or pleasure, excluding those coming for study, skilled or unskilled labor, or as representatives of foreign press.
(C)

(i) Alien in immediate and continuous transit through the U.S. for a period not exceeding 29 days.

(ii) Alien entitled to pass in transit to and from the United Nations Headquarters District and foreign countries.

(iii) Alien passing in transit through the U.S. for ship-to-ship liquid cargo transfer operations, not exceeding 180 days.
(D)

(i) Alien crewman on a vessel or aircraft intending to land temporarily and depart with the same vessel or aircraft.

(ii) Alien crewman on a fishing vessel intending to land temporarily in Guam or the Commonwealth of the Northern Mariana Islands.

(iii) Alien crewman performing ship-to-ship liquid cargo transfer operations, intending to land temporarily for a period not exceeding 180 days.
(E) Alien entitled to enter the U.S. under a treaty of commerce and navigation, engaged in substantial trade, directing enterprise operations, or performing services in a specialty occupation, subject to specific conditions, including nationality and investment criteria.
