Online Filing for Asylum Applicants

U.S. Citizenship and Immigration Services (USCIS) has announced a new initiative allowing specific asylum applicants to submit Form I-765, the Application for Employment Authorization, online. This change is particularly relevant for applicants falling under category (c)(8), which includes those with pending asylum applications and withholding of removal, as well as applicants under the ABC Settlement Agreement.

Effective immediately, eligible individuals can utilize the online filing option for Form I-765. The application for an Employment Authorization Document (EAD) based on a pending asylum application under category (c)(8) can be submitted 150 days after filing the asylum application, as indicated on the Form I-589 receipt notice.

To initiate the online filing process, applicants must create a USCIS online account at my.uscis.gov. This account, which comes at no cost, offers various features, including a secure inbox for direct communication with USCIS regarding the application. Existing account holders who have previously filed a USCIS form online can use their current accounts for this purpose. It's essential to note that online filing for Form I-765 is limited to specific categories of applicants. Filing under an ineligible category may result in the denial of the application without a fee refund.
