U.S. Citizenship and Immigration Services (USCIS) has announced updates to its visa availability approach for streamlining the management of the Form I-526, Immigrant Petition by Alien Investor, inventory, with the aim of enhancing operational efficiency.
The revised approach involves the grouping of petitions with filing dates on or before Nov. 30, 2019, based on the new commercial enterprise within the queue of petitions where the project has undergone review, and a visa is available or expected soon. This adjustment is designed to bring about greater processing efficiencies and alleviate existing backlogs. Consolidating multiple petitions linked to the same new commercial enterprise under the purview of the same adjudicator(s) is anticipated to enhance the overall efficiency of the adjudication process.
The issuance of this alert and the corresponding approach modification stem from considerations specific to the Form I-526 petition inventory, primarily aimed at addressing the backlog of pending petitions. Additional details can be found on the EB-5 Resources page under the "Update to Visa Availability Approach for Form I-526."
