Second Round of Random Selection Completed for FY 2024 H-1B Cap from Previously Submitted Registrations

USCIS has recently concluded the second random selection process from the pool of previously submitted registrations to meet the numerical allocations for the FY 2024 H-1B cap. A sufficient number of registrations were randomly selected, and all prospective petitioners with chosen registrations have been notified. They are now eligible to submit an H-1B cap-subject petition for the specified beneficiary mentioned in the selected registration.

Only petitioners with selected registrations have the authorization to file H-1B cap-subject petitions for FY 2024, and this filing is limited to the beneficiary named in the corresponding selected registration notice.

Properly filed H-1B cap-subject petitions must be submitted to the correct service center within the specified filing period indicated on the relevant registration selection notice. The filing period for the H-1B cap-subject petition will be a minimum of 90 days. Since online filing is not an option for H-1B petitions, petitioners must submit their petitions in paper form. Additionally, a printed copy of the applicable registration selection notice for FY 2024 must be included with the H-1B cap-subject petition.

It is important to note that registration selection solely determines eligibility to file an H-1B cap-subject petition. Petitioners, including those eligible for the advanced degree exemption, must still demonstrate eligibility for petition approval based on existing statutory and regulatory requirements when filing H-1B cap-subject petitions.
