On October 26, 2023, the USCIS is releasing new guidance concerning the EB-5 Regional Center Program. This update incorporates changes from the EB-5 Reform and Integrity Act of 2022 into the USCIS Policy Manual. It builds upon the initial update made on October 6, 2022.
The changes include reorganizing Part G, Volume 6 of the Policy Manual, with a few revisions to reflect the new structure. Additionally, the update focuses on regional center designation and obligations, project applications, and direct and third-party promoters, introducing content on registration as well.
This guidance takes immediate effect and supersedes any prior related guidance. USCIS is also planning further updates to the EB-5 guidance in the Policy Manual, which will include revisions to Chapter 5, addressing the Removal of Conditions. Stay informed for these upcoming changes.
