USCIS added a policy update that expands the eligibility criteria for employment authorization documents revolving on compelling circumstances. If you've been experiencing delays on your green card due to visa backlogs, you may qualify for an EAD.
The requirements required to be eligible are to have an approved Form 1-140 (Immigrant Petition for Alien Worker), and have a nonimmigrant status like H-1B, H-1B1, E-3, O-1, or L-1. Applicants must also provide biometrics, have a clean record, and have not previously filed an Adjustment of Status application.
An applicant may also qualify for an EAD if a disability requires him/her to move for treatment or affects their ability to do a prior job. Other factors that may help an applicant be eligible are: having a mortgage, school-age children, involvement in a dispute with your employer, or substantial harm due to job loss.
