USCIS Updates Policy Manual to Make It Easier to Identify Who Is Subject to the Public Charge Ground of Inadmissibility

USCIS has revised its Policy Manual, to simplify the identification of individuals subject to the Public Charge Ground of Inadmissibility. Significant details pertaining to the applicable adjustment of status categories are now moved from Volume 8, Part G's appendices to Chapter 3, Applicability. This adjustment aims to facilitate the determination of whether the public charge ground of inadmissibility is relevant to a specific adjustment of status category.

The purpose of this update is to enhance the accuracy of applicants' responses to questions regarding the public charge ground of inadmissibility on Form I-485, Application to Register Permanent Residence or Adjust Status. This, in turn, equips officers with the necessary information for adjudicating status adjustment applications and, when necessary, making public charge inadmissibility determinations, eliminating the need for a Request for Evidence on this matter.
