Seeking asylum is often a leap of faith

Many people believe that seeking protection in another country could help them escape the perils of their homelands. While this certainly can be the case in some situations, it is important to remember that seeking asylum in California and other parts of the United States involves meeting certain stipulations. Unfortunately, the process can be difficult.

One of the scarier parts of seeking asylum may be that it has to be done in person. This means that an immigrant must be within the borders of the United States or at an official port of entry, which could include an airport or land crossing. Parties cannot seek acceptance of asylum in advance, which means that they are taking a leap of faith in search of a better life.

If a person is at the border of the United States, he or she will likely face either immigration court removal proceedings or expedited removal. Court removal proceedings involve the person going before a judge and given the opportunity to request asylum. With expedited removal, a person does not get a hearing, but if he or she has a credible fear of returning to the native country, a credible fear interview may take place with an asylum officer.

Asylum can often help individuals seek the protections they need and that they would otherwise not get in their native countries. Because the process can be difficult to complete, it is often wise for interested individuals to obtain legal assistance.
